Payment Schedule:
Subscription fees are generally non-refundable. However, we may provide prorated refunds for service downtime or in cases of billing errors. Usage-based charges are final once incurred.
We reserve the right to suspend or terminate your access to the Service for non-payment. You will receive notice before suspension and an opportunity to resolve payment issues.
We strive to maintain 99.9% uptime for our API services. Planned maintenance will be announced in advance when possible.
We provide technical support through our dashboard and email. Response times vary by subscription tier, with priority support available for enterprise customers.
The Service, including all software, documentation, and content, is owned by Devious and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service according to these Terms.
You retain ownership of any data or content you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service.
Any feedback, suggestions, or ideas you provide about the Service may be used by us without compensation or attribution.
Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Data Processing: We process your data in accordance with applicable data protection laws, including GDPR and CCPA where applicable.
To the maximum extent permitted by law, Devious shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Important Legal Notice: Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to merchantability and fitness for a particular purpose.
You agree to indemnify and hold harmless Devious, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
You may terminate your account at any time by following the cancellation process in your dashboard. Termination will be effective at the end of your current billing period.
We may terminate or suspend your account immediately if you violate these Terms, fail to pay fees, or engage in prohibited activities.
Upon termination, your access to the Service will cease, and we may delete your data according to our data retention policy. Provisions that should survive termination will remain in effect.
These Terms are governed by the laws of the jurisdiction where Devious is incorporated, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.
